ACRO: We are taking seriously concerns about Freedom of Information advice on RIPA

The Freedom of Information Central Referral Unit was established by Chief Police Officers to provide to them,amongst other things, expert advice concerning their resposibilities as defined within the Freedom of Information Act. The Unit is based in Hampshire and is managed by Ian Readhead, the ACRO Chief Executive and Director of Information. He has been responding to concerns expressed in Press Gazette about advice issued to forces regarding FOI requests for information on applications made by police under the Regulation of Investigatory Powers Act (RIPA) which involved the interception of material relating to journalists.

Mr Readhead said: 

“I am aware of the issues which have arisen from a recent piece of advice to Chief Constables regarding the subject of RIPA applications involving journalists, published in an article in Press Gazette on Monday, November 10. 

“I appreciate the sensitivities arising from this advice and acknowledge that the need for the Police to protect the detail of current criminal investigations where RIPA is applied has to be balanced, wherever possible, with the right to privacy of the individual. We fully recognise and greatly value the principle of a free press and that any use of the RIPA process which may involve a journalist must be justified in law. 

“I have reviewed the advice provided to Chief Police Officers and, as a result of the concern this has caused the journalistic community, have today discussed the matter with the Office of the Information Commissioner – the regulatory authority for the Freedom of Information Act. Having taken their advice, we will act on any requests for an internal review from any of those who originally applied for the disclosure of this information. It will then be a matter for the applicant to decide whether they are satisfied with this process or wish to refer it to the Information Commissioner, who will then be able to adjudicate independently on whether forces have complied with the Act. The RIPA leads are concerned that, wherever we can, we are as open and transparent as possible about our use of powers , and continue to engage fully with all ongoing reviews of RIPA legislation and practice.  I am determined to ensure that the high standards we hold ourselves to under FOI are met.”
